Terms and Conditions

1. STANDARD TERMS

1.1 Information on how to enter and prize details form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.

1.2 The “Promoter” is Melbourne Rebels Rugby Union Pty Limited (ABN 70 140 597 066) of AAMI Park, Gate F, 60 Olympic Boulevard, Melbourne 3000

2. WHO CAN ENTER

2.1 Subject to clause 2.2 and 2.3, entry is open to all residents of Victoria who are active and paid members of the Melbourne Rebels in 2020.

2.2 Employees and their immediate families of the Melbourne Rebels, Victorian Rugby Union, suppliers, providers and agencies associated with this promotion are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

2.3 Entrants under the age of 18 must have obtained the permission of a parent/guardian to enter.

3. HOW TO ENTER

3.1 The competition commences on Tuesday 11 August 2020 at 5:00pm (AEST) and closes on Thursday 3 September 2020 at 5:00pm (AEST) (“the Competition Period”).

3.2 To enter the competition participants must pledge their 2020 Melbourne Rebels membership through the online survey or via email or phone during the Competition Period.

3.3 It is the responsibility of the entrant to ensure their details are submitted correctly to receive their entries.

3.4 Entries into the draw will be allocated based on the tier of the membership purchased in 2020 and will be allocated as follows:

3.4.1 Weary Dunlop and Platinum Members receive (20) entries per membership pledge

3.4.2 Gold Members receive (10) entries per membership pledge

3.4.3 Silver Members receive (5) entries per membership pledge

3.4.4 Blue, Flexi and Trans-Tasman Members receive (2) entries per membership pledge

3.5 The Promoter, its agents, affiliates or representatives will not be liable for any late, lost or misdirected entries.

4. HOW TO WIN

4.1 Each entrant who has entered the competition before the inclusion of the Competition Period in accordance with clauses 2 and 3 will be entered into the draw.

4.2 Competition winners will be selected at random after the closing of the competition on Thursday 3 September 2020 at 5:00pm (AEST).

4.3 The random selection will take place at Rugby Australia, Cnr of Moore Park Rd/Driver Ave, Moore Park, NSW, 2021 on Monday 7 September 2020 at 2:00pm.

4.4 Winners will be informed by email and the winners names will be published on the website http://www.melbournerebels.com before Friday 11 September 2020 at 5:00pm (AEST).

4.5 The Promoter’s decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding the result.

4.6 It is a condition of accepting the prize that the winner may be required to sign legal documentation, including but not limited to a legal release and indemnity, in a form determined by the Promoter in its absolute discretion.

4.7 Entries not completed in accordance with these terms and conditions will not be considered valid and will not be included in the draw. Indecipherable or incomplete entries will be deemed invalid.

4.8 The Promoter reserves the right to verify the validity and authenticity of any prize claim or entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits and entry that is not in accordance with these terms and conditions of entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

5. PRIZES

5.1 Subject to 5.8, there are ten Prizes (the “Prize Pool”) available which are:

5.1.1 $2,500 travel credit to enjoy a weekend away and attend a 2021 Melbourne Rebels away game of your choice.

5.1.2 Membership Upgrade to Two Weary Dunlop Memberships in 2021

5.1.3 Year’s supply of Brick Lane (case a fortnight) valued at $1,560

5.1.4 $500 Voucher for Coles Myer

5.1.5 $500 Uber Eats Voucher

5.1.6 $500 Rebel Sport Voucher

5.1.7 Year’s supply of Roll’d (one meal per week) up to $1,000

5.1.8 Ultimate Rebels Insider Experience: Golf with a Rebels Foursome, Coaches Box In-Game Experience, Join a Team Dinner in Melbourne leading into a home game

5.1.9 Luxury interstate trip to a Wallabies Test in 2021 including, Accommodation, Flights and Tickets to the value of $5,000

5.1.10 Premium Matchday Experience with 10 tickets to attend the Chairman’s Club for a home game of your choosing in 2021

5.2 Prize to take place during the 2020 or 2021 Melbourne Rebels season pending availability and at the Promoters discretion.

5.3 If the prize is unavailable, for whatever reason, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value or lesser value, and/or specification, subject to any written directions from a regulatory authority.

5.4 Prizes cannot be transferred, exchanged or redeemed for cash. In the event that the winner does not take the prize at the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize. Prize must be taken as offered and cannot be varied.

5.5 In accepting the prize, the winner agrees to participate and co-operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. The winner grants the Promoter a perpetual and non-exclusive license to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use.

5.6 The winner consents to the Promoter using the entrant’s name, likeness and image if they win (including photographs, film and or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome).

5.7 The winner must cover additional expenses associated in collecting the prize, including but not limited to, travel, taxes, accommodation, meals, drinks, medical expenses, and any items of a personal nature.

5.8 The Promoter reserves the right to add additional Prizes to the Prize Pool during the Competition Period in order to make the competition more appealing.

6. LIABILITY

6.1 The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.

6.2 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury, loss or damage (including loss or opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to, where arising out of the following:

6.2.1 Any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion;

6.2.2 Any problems, delays or technical malfunction or failures, or any other technical problems related to, or resulting from, the downloading of any materials related to this promotion (whether or not under the Promoter’s control);

6.2.3 Any theft, unauthorised access or third party interference;

6.2.4 Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

6.2.5 Any variation in prize value to that stated in these conditions of entry;

6.2.6 Any tax liability incurred by a winner or entrant; 6.2.7 The broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person; and/or participation in the prize.

6.3 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

7. FURTHER TERMS AND CONDITIONS

7.1 Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of a Promotional Platform or the information on a Promotional Platform, or to undermine the operation of this promotion may be a criminal and civil offence. Should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.

8. PRIVACY

8.1 All personal information you provide will be used by the Promoter in accordance with the Promoter’s Privacy Policy available at http://www.melbournerebels.com.au/privacy and may be disclosed by the Promoter in accordance with the Promoter’s Privacy Policy (including for promotional and marketing purposes). By providing your personal information you agree to such use by the Promoter.

9. FINAL AND BINDING

9.1 The Promoter’s decision in relation to any aspects of the competition is final and binding on every person who enters and no correspondence will be entered into. 

10. GOVERNING LAW

10.1 This Promotion is governed by the laws of Victoria and entrants and the Promoter irrevocably submit to the non-exclusive jurisdiction of the Courts of Victoria.
